Terms of Service

These Terms of Service ("Terms") govern your use of the FocusPact mobile application and website (collectively, the "Service") operated by FocusPact ("we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access or use the Service.

By creating an account or using our Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. We may modify these Terms at any time. We will notify you by posting the new Terms on this page and updating the "Last updated" date. Your continued use of the Service constitutes acceptance of the modified Terms.

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use the FocusPact mobile application on Apple-branded products that you own or control and as permitted by the App Store Terms and Conditions, including Family Sharing if enabled. All rights not expressly granted are reserved by us.

You may not:

• copy, modify, or create derivative works of the app
• reverse engineer, disassemble, or decompile the app
• distribute, sell, lease, rent, lend, or sublicense the app
• remove or alter proprietary notices
• use the app for any unlawful purpose
• access or use the app in any manner that violates applicable laws or regulations

To access certain features, you may need to create an account. You are responsible for:

• maintaining the confidentiality of your credentials
• all activities that occur under your account
• providing accurate, complete information and keeping it current

You agree not to use the Service to:

• violate laws or regulations
• infringe the rights of others
• transmit harmful, offensive, or inappropriate content
• interfere with or disrupt the Service or our systems
• attempt to gain unauthorized access to our systems
• use the Service for any commercial purpose without permission

Payment will be charged to your Apple ID account at confirmation of purchase. Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period. You can manage and cancel your subscriptions by going to your Account Settings on the App Store after purchase. Any unused portion of a free trial period, if offered, will be forfeited when you purchase a subscription.

We may change subscription offerings, prices, and features; any price changes will be communicated as required by applicable law and will take effect at the start of the next subscription period. If you do not agree to a price change, cancel before renewal.

Refund requests for in-app purchases and subscriptions are handled by Apple. For billing issues or refunds, visit reportaproblem.apple.com or manage your subscription in Settings > [your name] > Subscriptions.

The Service may rely on or link to third-party services (e.g., wireless data services, analytics, payment processors). Your use of such services may be subject to third-party terms and fees, and you are responsible for compliance with those terms.

We are solely responsible for providing maintenance and support services for the Service. Apple has no obligation to furnish any maintenance or support services with respect to the app.

We are responsible for addressing any claims by you or a third party relating to the app or its possession and/or use, including:

• product liability claims
• any claim that the app fails to conform to any applicable legal or regulatory requirement
• claims arising under consumer protection, privacy, or similar legislation

Nothing in these Terms shall be deemed an admission that any such claims have merit.

The Service and its original content, features, and functionality are and will remain the exclusive property of FocusPact and its licensors. These Terms do not transfer any intellectual property rights to you.

Please review our Privacy Policy, which describes how we collect, use, and disclose information about you. By using the Service, you consent to our data practices as described in the Privacy Policy.

You represent and warrant that you are not located in a country subject to a U.S. Government embargo or designated by the U.S. Government as a "terrorist supporting" country and that you are not listed on any U.S. Government list of prohibited or restricted parties. You agree to comply with all applicable export control and trade laws and regulations.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT DEFECTS WILL BE CORRECTED.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL FOCUSPACT OR ITS AFFILIATES, LICENSORS, OR SUPPLIERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY; OR (C) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE SHALL NOT EXCEED THE AMOUNTS PAID BY YOU TO US FOR THE SERVICE DURING THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. You may terminate your account at any time via the app or by contacting us.

Apple and Apple's subsidiaries are third‑party beneficiaries of these Terms, and upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third‑party beneficiary thereof.
